A House Republican is asking the Supreme Court to overturn a court decision to block President Donald Trump’s nominee to the Supreme Justice Court, saying that President Barack Obama “used the same tactics” to obstruct the nomination of Neil Gorsuch.
The lawsuit filed Monday seeks to halt Gorsuch’s nomination.
The lawsuit is the latest effort to thwart Gorsuch’s confirmation.
Gorsuch was confirmed in a 52-49 vote on Thursday.
Republicans have vowed to block Gorsuch, saying he’s too conservative to serve as the court’s chief justice.
On Friday, Senate Minority Leader Chuck Schumer and Democratic Sen. Patty Murray of Washington, D.C., introduced a resolution to block the nomination.
They are also calling on the Senate to move ahead on the nomination before the next president takes office.
